PRIVACY NOTICE REGARDING THE PROCESSING OF CUSTOMER PERSONAL DATA PURSUANT TO ARTICLES 13-14 OF EU REGULATION 2016/679 (GDPR)
This privacy notice is provided to Customers pursuant to Article 13 of EU Regulation 2016/679.
Data Controller
The Data Controller is Effepark srl, with registered office in Como, Via Pasquale Paoli, 114, VAT no. 03408340135.
Data type
The Processing relates to the Customer's Personal Data (name, surname, company name, address, landline/mobile telephone number, email address, VAT number and any other information relating to the Customer).
PURPOSE OF THE PROCESSING
The processing of personal data is based on the principles of fairness, lawfulness, transparency and the protection of the confidentiality and rights of the Customer and is carried out for the following purposes:
A. organising and carrying out activities connected and instrumental to the planning, initiation, conclusion and execution of contractual relationships;
B. performance of obligations arising from the contract concluded with the Client;
C. compliance with administrative, accounting, civil, fiscal, regulatory, EU and non-EU legal obligations;
D. general management of the customer relationship (acquisition of pre-contractual data and information, contacts, correspondence, orders, deliveries, invoices);
E. litigation management (contractual breach, formal notices, settlements, debt collection, legal disputes);
F. carrying out market research, sending advertising material and promotional activities (sending, including via email, information and communications relating to technical and commercial services, value-added services, pre- and post-sales services, new products/services and promotions), subject to the Customer's consent.
PROVISION OF DATA
Provision of the Data is mandatory and failure to provide them, either partially or inaccurately, may result in the impossibility of fulfilling contractual obligations.
Consensus
The consent given for conducting market research, sending advertising material and promotional activities can be revoked at any time pursuant to Article 6 of the GDPR.
METHOD OF TREATMENT
The processing is carried out using manual and/or IT and telematics tools with organisational and processing logics strictly correlated to the purposes themselves and in any manner designed to guarantee the security, integrity and confidentiality of the data in compliance with the organisational, physical and logical measures laid down by current provisions. The Customer's Personal Data are processed for the entire duration of the contractual relationship and subsequently for the performance of all civil law and tax obligations.
DATA TRANSFER
The Data is not transferred outside of the European Union, but the Data Controller reserves the right to change the location of the servers even outside of the European Union, ensuring, in that case, that the transfer will take place in accordance with the provisions and with the appropriate legal safeguards.
DATA RETENTION
The processing and storage of Data take place on servers located within the European Union, and where applicable, also with third-party companies appointed and duly designated as Data Processors. Personal Data are kept in a way that allows the identification of the Data Subject for no longer than is necessary to achieve the purposes for which they are processed and, in the event of revocation of consent, they will be deleted.
Data subject's rights
The Customer may, at any time, request:
1. to access personal data;
2. to obtain the rectification or erasure of the same or the restriction of processing concerning them;
3. to object to processing;
4. data portability;
5. to withdraw consent, where applicable: the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal;
6. to lodge a complaint with the supervisory authority (Data Protection Authority).
